NOTICE OF EXTRA-JUDICIAL SALE Upon Petition for Extra-Judicial Foreclosure of Real Estate Mortgage
under Act 3135, as amended fi led by ISAGANI B. BORRES, of legal age, married, Filipino Citizen, and a resident of Brgy. Libon, Panay, Capiz, Philippines, through counsel, Atty. Clinton D. Golingay, hereinafter referred to as the Petitioner/Mortgagee against Spouses Anthony B. Villaraiz and Mary Ann B. Villaraiz, of legal ages, Filipino Citizens, and residents of Brgy. Tico, Panay, Capiz, hereinafter referred to as Respondents/ Mortgagors, to satisfy the mortgage indebtedness of the Respondents/ Mortgagors to the Petitioner/Mortgagee which amounted to THREE HUNDRED FIFTY THOUSAND PESOS (Php 350,000.00), Philippine Currency, as principal amount of loan; TWO HUNDRED EIGHTY THOUSAND PESOS (Php 280,000.00), as interest from November 19, 2022 to July 30, 2023, plus Attorney’s Fees in the amount of FORTY THOUSAND PESOS (Php 40,000.00) and all fees/expenses incurred in the foreclosure proceedings, the undersigned Provincial Sheriff Ex-Officio of Capiz, or thru her authorized deputy sheriff will sell at a public auction on October 6, 2023 at 2:00 o’çlock in the afternoon at the Ground Floor
(Lobby), Hall of Justice, Roxas City, Philippines, to the highest bidder for CASH and in Philippine Currency, the property hereunder described with all the improvements thereon, to wit:

“A PARCEL OF LAND (Lot 2610 of the Cadastral Survey of
Panay), with the improvements thereon, situated in the Mun.
of Panay. Bounded on the NE. by Lot NE. by Lots 2579 and
2611; on the SE. by Lot 2611; and on the SW., and NW. by
Lot 2609. Containing an area of ELEVEN THOUSAND FIVE
HUNDRED TWENTY NINE (11,529) SQUARE METERS,
more or less. xxx.”
(NOTE : location of subject property is at Agbalo, Panay,
Capiz per attached Tax Declaration 004-0635 in the
Petition (Annex A-1)
“All sealed bids must be submitted to the undersigned on the above-
stated date and time.” “In the event the above-stated public auction date is declared a
holiday, or in case of fortuitous event such as typhoon, flood, or other
unforeseen event beyond the control of the offi cer conducting the sale, it
shall be held on October 13, 2023, at 2:00 o’çlock in the afternoon at the
Ground Floor (Lobby), Hall of Justice, Roxas City without further notice
and re-publication.”
Prospective buyers may investigate for themselves the title of herein
above-described property and the encumbrances thereon, if any there be.
