Upon Petition for Extra-Judicial Foreclosure of Real Estate Mortgage
under Act 3135, as amended, fi led by the HOME DEVELOPMENT
MUTUAL FUND (otherwise known as Pag-IBIG FUND), a government
fi nancial institution duly organized and existing under and by virtue
of Republic Act No. 9679, with principal offi ce at the Petron Mega
Plaza Building, 358 Sen. Gil Puyat Avenue, Makati City, Philippines,
herein represented by its Department Manager III of Bacolod Housing
Business Center, WILMER B. LIRAZAN, with offi ce address at Home
Development Mutual Fund, Bacolod Housing Business Center, 2nd Floor
Gaisano Grand Bacolod Mall, Araneta St. Singcang, Bacolod City,
and its Attorney-in-Fact ATTY. MELANIO A. BADENAS, JR. per
Special Power of Attorney attached in the Petition, with offi ce address
at GCCS & Associates Corporation, Rm. 209, Megastate Bldg., No. 737
G. Araneta Avenue, Tatalon, Quezon City and/or 4th Floor, Justina Bldg.,
Huervana St., Lapaz, Iloilo, hereinafter referred to as the Mortgagee,
against MA. RECHEL A. DIVINAGRACIA married to ROWEL B.
DIVINAGRACIA, both of legal age, Filipino Citizens, with postal address
at Brgy. Fe, Jamindan, Capiz, hereinafter referred to as the Mortgagors.
ROWEL B. DIVINAGRACIA is herein represented by MA. RECHEL
A. DIVINAGRACIA AS his Attorney-in-Fact, to satisfy the mortgage
indebtedness of the herein Mortgagors to the Mortgagee which as of July
31, 2023 amounted to TWO HUNDRED FOURTEEN THOUSAND
THREE HUNDRED TWENTY ONE PESOS & 27/100 CENTAVOS
(Php214,321.27), Philippine Currency, inclusive of interest and other
charges per Statement of Account attached in the Petition, and that likewise,
in case of foreclosure proceedings, the Mortgagors shall pay the Mortgagee
the foreclosure expenses and other monetary obligations, the undersigned
Provincial Sheriff Ex-Offi cio of Capiz or thru her Deputy Sheriff will sell
at a public auction on October 4, 2023 at 2:00 o’clock in the afternoon,
Ground Floor (Lobby), Hall of Justice, Roxas City, Philippines, to
the highest bidder for CASH and in Philippine Currency, the property
hereunder described with all the improvements thereon, to wit:
