O R D E R
Petitioner, SALVADOR A. AMARINERO, filed a verified Petition praying that he be appointed as the Administrator of the Intestate Estate of Ruth V. Amarinero, who was a resident of Arnaldo Boulevard, Barangay Baybay, Roxas City and who allegedly died without a last will and testament on December 14, 2018, leaving properties to her surviving spouse and sole child, consisting of: a) a real property, which is a parcel of land situated at Brgy. Baybay, Roxas City with an assessed value of Sixteen Thousand Three Hundred and Forty Pesos (P 16,340.00) and with a market value of Five Hundred Forty Four Thousand and Eight Hundred Pesos (P544,800.00); b) a residential house/building erected on the abovestated parcel of land with an assessed value of Twenty Thousand Seven Hundred Fifty Pesos (P24,750.00) and with a market value of Two Hundred Forty Seven Thousand Four Hundred Seventy Four and 50/100 centavos (P247,474.50); and c) monetary deposits in the aggregate amount of Two
Hundred Ninety Three Thousand Sixty-Five Pesos and 50/100 centavos (P293,065.50). Further, petitioner prayed that the corresponding Letters of Administration be issued in his favor and pending the issuance of the same, petitioner prayed that he be appointed as the Special Administrator and for the Court to declare petitioner as owner of the three fourths (3/4) of the above-enumerated properties.
The petition is set for hearing on JANUARY 12, 2023 at 8:30 o’clock in the morning. Cause notice thereof to the known heir/s and creditor/s, if any, of the decedent, RUTH V. AMARINERO, and to any other person/s believed to have an interest in the estate. The Court is hereby directing the petitioner to cause the publication of this Order at his own expense for three (3) consecutive weeks in a newspaper of general circulation in the Province of Capiz.
Any interested person my by filing a written opposition, contest the petition on the ground of the incompetency of the person for whom letter are prayed therein, or on the ground of the contestant’s own right to the administration, and may pray that the letters issue to himself or any to competent persons or persons named in the opposition.
